This Privacy Policy (hereinafter - the Privacy Policy) applies to all information that the online store "Ukr-product", located at - https://www.ukr-produkt.shop may receive about the User when using the site -store, programs and products of the online store.
1. Definition of terms
1.1 The following terms are used in this Privacy Policy:
1.1.1. "Administration of the site of the Online Store (hereinafter - the Administration of the Site)" - authorized employees to manage the site, acting on behalf of the online store Ukr-product, who organize and process personal data, as well as determine the purposes of personal data processing, personal data composition to be processed, actions or operations carried out with personal data.
1.1.2. "Personal data" - any information that relates directly or indirectly to an individual or is determined by an individual (personal data subject).
1.1.3. "Processing of personal data" - any action (operation) or set of actions (operations) carried out with or without the use of automation means with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
1.1.4. "Confidentiality of personal data" - mandatory for the Administrator or others who have gained access to personal data by a person not to allow their dissemination without the consent of the personal data subject or the presence of other legal grounds.
1.1.5. “A user of the Ukr-product online store site is a person who has access to the Site via the Internet and uses the Online Store Site.
1.1.6. "Cookies" are a small piece of data sent by a web server and stored on a user's computer, which the web client or web browser sends to the web server each time in an HTTP request when trying to open a page of the relevant site.
1.1.7. "IP address" - a unique network address of the node in a computer network built on the IP protocol.
2. General provisions
2.1. The User's use of the Online Store website constitutes consent to this Privacy Policy and the terms of processing the User's personal data.
2.2. In case of disagreement with the terms of the Privacy Policy, the User must stop using the website of the Online Store.
2.3.This Privacy Policy applies only to the site of the online store "Ukr-product". The online store does not control and is not responsible for the sites of third parties, to which the User can go through the links available on the site of the online store.
2.4. The site administration does not check the accuracy of personal data provided by the User of the online store site.
3. SUBJECT OF THE PRIVACY POLICY
3.1. This Privacy Policy sets out the obligations of the Online Store Site Administration not to disclose and ensure the protection of personal data, which the User must provide to the Site Administration upon registration on the online store site or when placing an order to purchase the Goods.
3.2. Personal data allowed for processing under this Privacy Policy are provided by the User by filling in the registration form on the Website of the Ukr-product online store in the registration section and include the following information:
3.2.1. Name of the User;
3.2.2. contact phone of the User;
3.2.3. e-mail address;
3.2.4. delivery address of the Goods;
3.2.5. place of residence of the User.
3.3. The online store protects the data that is automatically transmitted during the viewing of ad units and when visiting the pages on which the statistical script of the system ("pixel") is installed:
• IP address;
• information from cookies;
• information about the browser (or other program that accesses the display of advertising); • access time;
• the address of the page on which the ad unit is located;
• referrer (previous page address).
3.3.1. Disabling cookies may result in inability to access parts of the online store site that require authorization.
3.3.2. The online store collects statistics about the IP addresses of its visitors. This information is used to identify and resolve technical issues, to monitor the legality of financial payments.
3.4. Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) is subject to secure storage and non-dissemination, except as provided in p. 5.2. and 5.3. of this Privacy Policy.
4. OBJECTIVES OF COLLECTING PERSONAL INFORMATION OF THE USER
4.1. The User's personal data may be used by the Administration of the online store site for the purposes of:
4.1.1. Identification of the User registered on the website of the Online Store, for ordering and (or) concluding a Contract for the purchase and sale of goods remotely with the Online Store.
4.1.2. Providing the User with access to personalized resources of the Online Store Site.
4.1.3. Establishing feedback with the User, including the direction of messages, inquiries related to the use of the Online Store Site, provision of services, processing of inquiries and requests from the User.
4.1.4. Determining the location of the User to ensure security, prevent fraud.
4.1.5. Confirmation of the accuracy and completeness of personal data provided by the User.
4.1.6. Create an account for purchases, if the User has agreed to create an account.
4.1.7. Notification of the User of the Online Store Site about the status of the Order.
4.1.8. Processing and receipt of payments, confirmation of tax or tax benefits by the User.
4.1.9. Providing the User with effective customer and technical support in case of problems related to the use of the Online Store Site.
4.1.10. Providing the User with his consent, product updates, special offers, price information, newsletters and other information on behalf of the Online Store or on behalf of the partners of the Online Store.
4.1.11. Implementation of advertising activities with the consent of the User.
4.1.12. Providing access to the User to the sites or services of the partners of the Online Store in order to receive products, updates and services.
5. METHODS AND TERMS OF PROCESSING PERSONAL INFORMATION
5.1. Processing of personal data of the User is carried out without limitation of the term, in any lawful way, including in information systems of personal data with use of means of automation or without use of such means.
5.2. The User agrees that the Site Administration has the right to transfer personal data to third parties, in particular, courier services, postal organizations, telecommunications operators, solely for the purpose of fulfilling the User's order placed on the Site of the online store "Ukr- product ", including delivery of the Goods.
5.3. Personal data of the User may be transferred to the authorized bodies of state power of Ukraine only on the grounds and in the manner prescribed by the legislation of Ukraine.
5.4. In case of loss or disclosure of personal data, the Site Administration informs the User about the loss or disclosure of personal data.
5.5. The site administration takes the necessary organizational and technical measures to protect the personal information of the User from unauthorized or accidental access, destruction, distortion, blocking, copying, distribution, as well as other illegal actions of third parties.
5.6. The site administration together with the User takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of personal data of the User.
6. Obligations of the parties
6.1. The user must:
6.1.1. Provide information about personal data required to use the Ukr-product online store site.
6.1.2. Update, supplement the provided information about personal data in case of change of this information.
6.2. The site administration is obliged to:
6.2.1. Use the information obtained exclusively for the purposes specified in paragraph 4 of this Privacy Policy.
6.2.2. Ensure the confidentiality of confidential information, not to disclose without the prior written consent of the User, as well as not to sell, exchange, publish, or disclose in other possible ways the transferred personal data of the User, except for p. 5.2. and 5.3. of this Privacy Policy.
6.2.3. Take precautions to protect the confidentiality of the User's personal data in accordance with the procedure normally used to protect such information in existing business transactions.
6.2.4. Block personal data related to the relevant User from the moment of application or request of the User or his legal representative or authorized body for protection of the rights of personal data subjects for the period of verification, in case of detection of inaccurate personal data or illegal actions.
7. RESPONSIBILITY OF THE PARTIES
7.1. The administration of the site, which has not fulfilled its obligations, is liable for damages incurred by the User in connection with the misuse of personal data, in accordance with the laws of Ukraine, except as provided in p. 5.2., 5.3. and 7.2. of this Privacy Policy.
7.2. In case of loss or disclosure of Confidential Information, the Site Administration is not responsible if this confidential information:
7.2.1. It became public property before its loss or disclosure.
7.2.2. It was received from a third party before it was received by the Site Administration.
7.2.3. Was disclosed with the consent of the User.
8. Dispute resolution
8.1. Prior to filing a lawsuit in disputes arising from the relationship between the User of the online store site and the Administration of the site, it is mandatory to file a claim (written proposal for voluntary settlement of the dispute).
8.2. The recipient of the claim within 30 calendar days from the date of receipt of the claim, notifies the claimant in writing of the results of the claim.
8.3. If no agreement is reached, the dispute will be referred to a judicial body in accordance with the current legislation of Ukraine.
8.4. The current legislation of Ukraine applies to this Privacy Policy and the relationship between the User and the Site Administration.
9. ADDITIONAL CONDITIONS
9.1. The site administration has the right to make changes to this Privacy Policy without the consent of the User.
9.2. The new Privacy Policy comes into force from the moment it is posted on the Online Store Site, unless otherwise provided by the new version of the Privacy Policy.
9.3. All suggestions or questions regarding this Privacy Policy should be reported in the "Privacy Policy" section.

1. Terms

1.1. This offer is an official offer of the store "Ukr-product", hereinafter - "Seller", to enter into a contract of sale of goods remotely, ie through the online store, hereinafter - "Agreement", and places a public offer (offer ) on the official website of the Seller https://www.ukr-produkt.shop (hereinafter - the "Website").

1.2. The moment of full and unconditional acceptance by the Buyer of the Seller's offer (acceptance) to enter into an electronic contract of sale of goods, is the fact of payment by the Buyer of the order under this Agreement, within the terms and prices indicated on the Seller's website.

1. Concepts and definitions

2.1. In this offer, unless the context otherwise requires, the following terms have the following meanings:

* "Goods" - food;

* "Online store" - in accordance with the Law of Ukraine "On e-commerce", a means of presenting or selling goods, works or services through an electronic transaction.

* "Seller" - a company that sells goods presented on the Internet site.

* "Buyer" - an individual who has entered into an Agreement with the Seller on the terms set out below.

* "Order" - the choice of individual items from the list of goods specified by the Buyer when placing an order and making a payment.

1. Scope of the contract

3.1. The Seller undertakes to transfer the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.

This Agreement regulates the purchase and sale of goods in the Online Store, including:

- voluntary choice by the Buyer of goods in the online store;

- independent registration of the order in the Online store by the Buyer;

- payment by the Buyer of the order placed in the Online Store;

- processing and delivery of the order to the Buyer in the property under the terms of this Agreement.

1. Ordering procedure

4.1. The buyer has the right to place an order for any product presented on the website of the online store and available.

4.2. Each item can be presented in the order in any quantity.

4.3. In the absence of goods in the warehouse, the Company's Manager is obliged to notify the Buyer (by phone or by e-mail).

4.4. In the absence of the goods the Buyer has the right to replace it with the goods of similar model, to refuse the given goods, to cancel the order.

1. The order of payment of the order

5.1. Payment is made upon receipt of the goods at the branch of the transport company for cash payment in UAH.

5.2. If no funds are received, the online store reserves the right to cancel the order.

1. Terms of order delivery

6.1. Delivery of goods purchased in the online store is carried out by the company's couriers and Nova Poshta.

6.2. Together with the order, the Buyer is provided with documents in accordance with the legislation of Ukraine.

1. Rights and duties:

7.1. The seller has the right to:

- unilaterally terminate the provision of services under this agreement in case of violation by the Buyer of the terms of this agreement.

7.2. The buyer must:

- timely pay and receive orders under the terms of this agreement.

7.3. The buyer has the right to:

- place an order in the online store;

- draw up an electronic contract;

- require the Seller to comply with the terms of this Agreement.

1. Responsibilities of the parties

8.1. The Parties shall be liable for non-performance or improper performance of the terms of this agreement in the manner prescribed by this agreement and current legislation of Ukraine.

8.2. The seller is not responsible for:

- the appearance of the Goods changed by the manufacturer;

- for a slight mismatch of the color scheme of the product, which may differ from the original product only due to the different color rendering of personal computer monitors of individual models;

- for the content and truthfulness of the information provided by the Buyer when placing an order;

- for delays and interruptions in the provision of Services (order processing and delivery of goods), which occur for reasons beyond its control;

- for illegal illegal actions committed by the Buyer through this access to the Internet;

 

- for the transfer by the Buyer of its network identifiers - IP, MAC-address, login and password to third parties;

8.3. The buyer, using the access to the Internet provided to him, is independently liable for damage caused by his actions (personally, even if under his login was another person) to persons or their property, legal entities, the state or moral principles of morality.

8.4. In case of force majeure, the parties are released from the terms of this agreement. Force majeure for the purposes of this Agreement means events that are extraordinary, unforeseen, which exclude or objectively interfere with the implementation of this Agreement, the occurrence of which the Parties could not foresee and prevent in reasonable ways.

8.5. The parties shall make every effort to resolve any differences solely through negotiations.

1. Miscellaneous

9.1. The online store reserves the right to unilaterally amend this agreement subject to its prior publication on the website https://www.ukr-produkt.shop

9.2. An online store is designed to organize a remote way of selling goods over the Internet.

9.3. The buyer is responsible for the accuracy of the information provided when ordering information. In this case, upon acceptance (ordering and subsequent payment for the goods), the Buyer provides the Seller with his unconditional consent to the collection, processing, storage, use of their personal data, within the meaning of the Law "On Personal Data Protection".

9.4. Payment by the Buyer for the order placed in the Online Store means the Buyer's full consent to the terms of the contract of sale (public offer)

9.5. The actual date of the electronic agreement between the parties is the date of acceptance of the terms, in accordance with Art. 11 of the Law of Ukraine "On e-commerce"

9.6. The use of the online store resource for previewing the goods, as well as for placing an order for the Buyer is free of charge.

9.7. The information provided by the Buyer is confidential. The online store uses information about the Buyer exclusively for the purpose of processing the order, sending messages to the Buyer, delivery of goods, settlements, etc.

1. The procedure for returning goods of proper quality

10.1. Return of goods to the online store is carried out in accordance with current legislation of Ukraine.

10.2. Return of goods to the online store is made at the expense of the Buyer.

10.3. When the Buyer returns the goods of proper quality, the Online Store returns to him the amount paid for the goods upon return of the goods less compensation for the costs of the Online Store related to the delivery of the goods to the Buyer.

10.4. Flowers are not subject to return or exchange.

1. Term of the contract

11.1. An electronic agreement is considered concluded from the moment the person who sent the proposal to enter into such an agreement receives a response on the acceptance of this proposal in the manner prescribed by part six of Article 11 of the Law of Ukraine "On Electronic Commerce".

11.2. Until the expiration of this Agreement may be terminated by mutual consent of the parties until the actual delivery of the goods, by refund

11.3. The parties have the right to terminate this agreement unilaterally, in case of non-fulfillment by one of the parties of the terms of this Agreement and in cases provided by the current legislation of Ukraine.

Terms of return of goods

In accordance with the provisions of Article 707 of the Civil Code of Ukraine and Article 9 of the Law of Ukraine "On Consumer Protection", when buying a non-food product of proper quality, you have the right to exchange it for a similar product if it does not suit you for any reason. For example, you have the right to exchange the product if it does not suit you in shape, size, style, color, size or other reasons why the product can not be used for its intended purpose.

Only goods of proper quality that have not been used by you and that have retained their appearance, properties, packaging, seals and labels are subject to return. In this case, you have no right to refuse to return the goods.

The return period for such goods is 14 days, not counting the day of purchase of the goods (unless the seller has announced a longer return period).

To return a product of proper quality that you did not like, you must keep a payment document confirming the purchase of the product (check or similar document). Also, when returning the goods, you must have a passport to present to the seller.

If you decide to exchange the product, and a similar product is no longer for sale, you have the right to purchase any other product for the same money. You also have the right to terminate the contract and get your money back. Note that when terminating the contract of sale, settlements with the consumer are based on the value of the goods at the time of purchase (money paid for the goods are returned on the day of termination of the contract, and in case of impossibility to return the money on that day - in another term by agreement of the parties, but not later than within seven days).

If you still decide to exchange, and the product is not available, you have the right to exchange the product for the first delivery of a new product. The seller is obliged to inform you about the delivery of the goods on the same day when it is delivered.

At the same time, it should be taken into account that at the legislative level there is a list of goods of proper quality that cannot be returned (Resolution of the Cabinet of Ministers of Ukraine of March 19, 1994 for № 172).
